Welcome to WhosTheDumbass.com ("the Site"), operated by WhosTheDumbass ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

1. Overview

WhosTheDumbass.com is an entertainment website that provides a humorous, non-scientific IQ-style quiz and a public leaderboard. The Site is intended for entertainment purposes only. Scores and rankings displayed on the Site are not an accurate measurement of intelligence and should not be interpreted as such.

2. Eligibility

You must be at least 13 years of age to use the Site. By using the Site, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. User Accounts & Submissions

When you take the quiz, you provide a display name that appears on the public leaderboard.
You are responsible for any name or content you submit. Do not use names that are offensive, impersonate real individuals, or violate the rights of others.
We reserve the right to remove any username or leaderboard entry at our sole discretion without notice.
You may optionally provide a URL link to be displayed on the leaderboard. You are solely responsible for the content of any linked website.

4. Boost Payments (Cryptocurrency)

The Site offers optional "boost" payments via Solana (SOL) and Ethereum (ETH) cryptocurrency to increase your leaderboard ranking.
All payments are final and non-refundable. Cryptocurrency transactions are irreversible by nature once confirmed on the blockchain.
Boost payments are for entertainment purposes and provide a ranking adjustment on the leaderboard. They do not entitle you to any ownership, service level agreement, or guaranteed outcome.
Cryptocurrency prices are fetched from third-party APIs (CoinGecko) and may fluctuate. The amount of crypto you pay is determined at the time of the transaction. We are not responsible for price changes between when you view a price and when the transaction is confirmed.
We are not responsible for failed, lost, or misdirected transactions resulting from user error, wallet malfunctions, or blockchain network issues.
By making a payment, you confirm that you are legally permitted to transact in cryptocurrency in your jurisdiction.

5. Leaderboard & Public Display

Your chosen display name, quiz score, rank, and any URL you provide will be publicly visible on the leaderboard.
We may display payment badges (e.g., 💸, 🐋, 👑) next to names of users who have made boost payments.
We do not guarantee the accuracy, permanence, or availability of leaderboard data. Leaderboard data may be reset, modified, or deleted at any time.

6. Prohibited Conduct

You agree not to:

Use bots, scripts, or automated tools to submit quiz answers or manipulate the leaderboard.
Attempt to interfere with the Site's operation, servers, or connected infrastructure.
Submit offensive, threatening, defamatory, or illegal content.
Impersonate another person or entity.
Attempt to reverse-engineer, decompile, or extract source code from the Site (beyond what is publicly available in our open-source repository).

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, design, and code, is owned by WhosTheDumbass or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Third-Party Services

The Site integrates with third-party services including but not limited to:

Phantom Wallet and MetaMask for cryptocurrency transactions
CoinGecko for cryptocurrency pricing
Solana and Ethereum blockchain networks
Cloudflare for hosting and API services

We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party wallets and blockchain networks is governed by their respective terms.

9. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHOSTHEDUMBASS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF CRYPTOCURRENCY, DATA, OR PROFITS, ARISING FROM YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless WhosTheDumbass and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third party's rights.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Upon termination, your right to use the Site ceases immediately. Sections regarding payments, liability, and indemnification survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
